Gordon & Rees California Team Authors Article on Wage Statement Law for Daily Journal

Partners Debra Ellwood MeppenBrandon D. SaxonMarie Trimble Holvick, and Summer Associate Burke Wynne authored an article entitled "Split decisions, unsettled consequences: The implications of conflicting rulings on wage statement violations," published by Daily Journal in its Labor & Employment special feature.

This article explores the area of contention surrounding California Labor Code § 226, which imposes specific requirements on employers when it comes to wage statements, and seeks to unravel the complexities of the "good faith belief" defense versus the "predicate facts" test. It also addresses the practical implications, potential consequences, and pressing need for a definitive resolution by the California Supreme Court, following the Gola v. Univ. San Francisco decision.

Ms. Meppen is Partner in the firm's Los Angeles office and serves as Chair of the National Employment Law Practice Group. She represents and defends employers, management, and talent in all aspects of federal and California employment matters. She also leads the firm’s Women’s Initiative, developed to support and encourage female attorneys on leadership and professional growth.

Mr. Saxon is Assistant Managing Partner of the firm's San Diego office and Chair of the office’s Employment Law Practice Group. His practice focuses on a wide range of civil litigation matters focusing on the defense of companies and employers in employment and commercial-related actions. He has litigated a number of matters to successful resolution in both state and federal courts and has experience in a variety of heavily regulated practice areas.

Ms. Holvick is Managing Partner of the firm’s San Francisco and Oakland offices. She has expertise in handling employment matters involving allegations of discrimination, harassment, retaliation, and wrongful termination. Ms. Holvick also regularly handles lawsuits involving class action “wage and hour” violations and Private Attorney General Act claims.
